Running a successful Annual General Meeting (AGM) is crucial for the effective governance and management of Sectional Title Schemes in South Africa.

Under the Sectional Titles Schemes Management Act, 8 of 2011 (STSMA), certain guidelines and procedures must be followed to ensure compliance and transparency. In this guide, weโ€™ll explore the key steps to conducting a successful AGM while adhering to the requirements of the STSMA.

Understanding Sectional Title AGM Requirements:
Familiarize yourself with the provisions of the STSMA relating to AGMs. This includes knowing the minimum notice period, quorum requirements, agenda items, and voting procedures outlined in the legislation.

How to Prepare for a Successful AGM:
Start by setting a date for the AGM well in advance to allow for proper planning. Prepare a comprehensive agenda that covers all the necessary items as per the STSMA, including approval of financial statements, appointment of trustees, and approval of budgets.

AGM Notice Period and Communication Requirements:
Ensure that all owners receive proper notice of the AGM in accordance with the STSMA. The notice should be sent out within the prescribed timeframe, usually at least 14 days before the meeting, and should include the agenda items to be discussed.

Engagement and Participation at an AGM:
Encourage active participation from all owners by fostering an inclusive and welcoming atmosphere during the AGM. Provide opportunities for owners to ask questions, raise concerns, and contribute to discussions related to the management of the Sectional Title Scheme.

AGM Quorum and Voting Procedures:
